§ 1 Scope

These terms and conditions apply to all orders placed through the ERGOPONG online store at ergopong.de.

The contracting parties are Ergopong OG, represented by the managing directors Martin Wimmer and Georg Edelmaier, and the customer.

§ 2 Customer Account & Contract Formation

  • A customer account is required to place an order. Guest checkout is not available.
  • By clicking “order with obligation to pay”, the customer submits a binding purchase offer.
  • The purchase contract is concluded with the order confirmation sent by email.

§ 3 Payment Terms

  • Payment via PayPal, credit card, or bank transfer.
  • Prepayment required: shipment occurs only after payment is received.
  • All prices include VAT. Shipping costs are shown separately during checkout.

§ 4 Shipping & Delivery

  • We ship only to countries listed in the online shop.
  • Shipping costs depend on destination & weight and are shown during checkout.
  • Shipping time: up to 10 working days after payment (due to custom manufacturing).
  • Shipping provider: Austrian Post.
  • The shipping risk is borne by Ergopong OG.

§ 5 Retention of Title

No retention of title applies, as payment in advance is mandatory.

§ 6 Right of Withdrawal & Returns

  • Customers have the legal right to withdraw within 14 days without giving reasons.
  • Return shipping costs are borne by the customer.
  • No withdrawal right for customized products (§18 Sec. 1 Z 3 FAGG).
  • This includes, but is not limited to, engraved or custom-modified items.
  • Note: Please check your order carefully. Returns for personalized products are excluded.

§ 7 Warranty

  • Legal warranty period: 2 years from receipt of goods.
  • In case of defects: customer may request repair or replacement.
  • If that fails: reduction of price or cancellation of contract possible.

§ 8 Liability

  • Full liability for intent and gross negligence.
  • Limited liability for slight negligence only in case of essential contractual duties.
  • Any further liability is excluded.

§ 9 Jurisdiction & Applicable Law

  • Austrian law applies (excluding UN sales law).
  • Jurisdiction: Regional Court St. Pölten.
